Nebraska has been slower to change its marijuana laws than some other states. Let’s take a look at the status of medical and recreational marijuana laws in Nebraska (and surrounding states).

Marijuana laws have changed significantly in recent years but not in Nebraska.

Medical Marijuana

Medical marijuana is not legal in Nebraska. Several attempts to legalize it have been made, but none have been successful.

Recreational Marijuana

Recreational marijuana is also illegal in Nebraska. Possession, use, or distribution of marijuana for non-medical purposes can result in legal consequences.

Penalties and Legal Consequences

In Nebraska, marijuana possession penalties depend on the amount and prior convictions. First-time offenders with less than an ounce can face a civil infraction, a $300 fine, and a drug education course.

Possessing more than an ounce can result in misdemeanor charges, fines, and jail time.

Distribution and cultivation are felonies with potential for substantial prison time and fines.
